Description
Individual constitutional rights and liberties. This course explores the role of the courts in interpreting and applying constitutional requirements protecting individual rights and liberties, and defining the content of constitutional rights, including implied rights. It explores the state action concept, both as a foundation for and limitation on the reach and enforcement of those rights. Primary topics will include protection of privacy interests and substantive due process, equal protection with emphasis on race and gender discrimination, and an introduction to freedom of expression. Depending on class size and feasibility, course method may involve detailed consideration of cases pending before the United States Supreme Court to explore the conceptual foundations for opposing litigant's positions.
